SUMMARY: This is a lawsuit resulting from a motor vehicle accident in 2009 on Paxton Street in Harrisburg. Plaintiff William Vitez was stopped at an intersection when he was rear ended by a work truck being driven by an employee of defendant, Inclinator Company of America. Both the company and the employee driving the truck, Tonya Mace, were named as defendants in the original complaint charging negligence for the manner in which the vehicle was allegedly driven. Dawn Vitez is also named as a Plaintiff charging an additional count of Loss of Consortium for the alleged deprivation of society and services of her husband as result of the accident. For this, and the injuries claimed to have been sustained, an award in excess of $50,000 was requested. On October 22, 2012 a jury found in favor of the Defendant.

From: Dauphin County Reporter This accident occurred on October 9, 2000. Negligence was admitted but Defendants argued that their negligence was not the factual cause of Plaintiff’s injuries. Plaintiff William Vitez, a car salesman, was rear-ended by a truck driven by Tonya Mace who was within the scope of her employment with Inclinator Company of America. Plaintiff’s face struck the middle pillar of the car and he suffered a concussion, lost tooth, contusions and a neck sprain. He returned to work eight days after the accident.
